Definitions
Manmilan Vivah Sanstha Registered Marriage Bureau working for Maharashtra/Marathi Community through online and offline web services through themselves and their authorised service points from Satara, Maharashtra — hereinafter mentioned as “Firm”.
Service Profiles registered with us for marriage are posted (by customers themselves or by the Firm on customer’s request) and displayed to our registered customers and service points on our exclusive website —
https://www.manmilan.in. All services done using this website and its use are the services provided by the Firm on our terms and conditions.
Package / Packages Package is the choice provided by the Firm to the customer which contains services to be provided. These packages are designed and delivered by the Firm and may change from time to time without notice. The Firm reserves the right to alter, amend, delete, cancel, introduce or change packages as per their own decision without notice. Services are automatically or manually suspended by the Firm without notice when the package period lapses.
Service Points Service Points are the Firm’s authorised associates. Customers may register with the Firm through our authorised service points. Those registered through service points shall abide with all terms and conditions. Those service points that are terminated or cancelled — their customers are not liable for any service from the Firm. Only customers with valid package validity are liable for taking benefits of services.
Customers Customers are those registered profiles who have validly entered their information and complied with all necessary requirements with the Firm. Those who have entered wrong, false, misleading or illegal information are not held as customers. Those who get married (through the Firm’s reference or otherwise) shall be deemed as terminated customers and shall be bound to inform the Firm of their marriage. Customers can also be referred to as users or “you”.
Authorised Gateways of Payment Payments shall be made only on the Firm’s authorised payment gateways — i.e. the Firm’s authorised bank account, Firm’s office counter, or service point’s authorised office counter. Customers shall confirm bank details and payment demands with the Firm’s administration desk before making any payment. Fake calls and fake bank accounts may approach customers — be aware and do not pay any amount to such people. Payments made to fake agents are not considered as paid to the Firm and no liability shall be binding on the Firm in such cases.
Authorised Staff The Firm’s appointed, enrolled and employed staff is called authorised staff and must be salaried by the Firm. Staff who have left or been terminated are not deemed as authorised staff. Any transactions done by them after termination are not legal and binding on the Firm.
Third Party Registrations Those registrations which are paid or registered by someone other than Class-1 relatives are third party registrations. Only the beneficiary and his/her Class-1 relatives can use the services as per the package. The payer of the beneficiary neither becomes a customer of the Firm nor can use the services. Such registrations are called third party registrations.
Breach of Terms and Conditions Violation of terms and conditions, complaint against a customer, prima-facie evidence of default or breach of T&C, default in payment, use of profile for financial demands, physical favour, any kind of personal relationship other than marriage, use for any purpose other than finding a prospective lawful matrimonial alliance — all are held as breach of Terms and Conditions.
Terms and Conditions
1. The customer has only a right to use the services offered by the Firm as per their package.
2. The Firm shall not take any liability or commit any promise of arranging marriages.
3. The customers shall pay package charges and register with true information before use of services provided by the Firm.
4. Fees/package charges once paid cannot be refunded back in any case.
5. The customers shall fill up the form online or offline before use of the services.
6. After registering with the Firm’s authorised website, the customers can see their profile within 24 hours and can use and see the matching profiles as per their authorised service.
7. If other registered profiles think fit, they may contact you directly by approaching you through the Firm’s website for further discussion.
8. The Firm will provide suggestions every 15 days through email and/or SMS as a complimentary service. This is a free service, not part of any package, and may be terminated without notice.
9. Customers can see matching profiles anytime on the website during their package validity period.
10. The customer shall without fail and with immediate effect give intimation of their marriage — if fixed or done — to the Firm. Unless done so, he/she shall be treated as an unauthorized customer and held liable for legal action. After marriage, they shall not use the services of the Firm as an authorised user.
11. The customers shall confirm and investigate proper information of matching profiles while contacting — on their own risk.
12. In case of false or misleading information given by any matching profile, the Firm shall not be held liable. Any losses arising from such activity — the Firm shall not be held liable or binding for any losses. The customer is solely held liable for losses, if any.
13. The Firm shall not take any responsibility for the truthfulness or valid intention of other customers. The same shall be cross-checked by the customer as their own duty.
14. The Firm shall not guarantee match making or marriage fixation in any time or within the period of the package. The Firm is only a service medium to locate and find the best match for you.
15. Customers shall not copy, transfer or share data provided under the services. If found doing so, such a customer can be terminated or de-registered by the Firm without notice and shall be held liable for legal action and compensation.
16. A customer’s intention to register with the Firm shall be legal and in accordance with the prevailing laws of the land. Any person prohibited by law shall not register. If they do, such registration shall be treated as void and the user shall be held liable for legal action and compensation.
17. The customer shall explain in the registration form the reason for enrolment — whether registering for self, daughter, son, father, mother, etc. The use of registration is limited and provided only for Class-I members of the family.
18. Customers shall clearly mention the intention of registration i.e. for which person/beneficiary they are registering. If it involves third party registration, the concerned person’s written or electronic consent is mandatory before registering. The beneficiary will become the Firm’s customer — not the payer — and shall be bound by all terms and conditions.
19. The customer hereby authorises the Firm to use, refer, copy and share their profile to others for the same matrimonial purpose. The Firm is authorised to communicate with others for profile matching. In case of theft or misuse of the customer’s electronic data by a third party, the user cannot claim any losses or damages from the Firm. They may take legal action against such third parties as per the law in force.
20. The Firm is hereby authorised by the customer to send, share and transfer all or partial information to other users or profile holders to investigate, communicate and contact. For this, the Firm may use any electronic and traditional medium such as SMS, WhatsApp, Email, Letter, etc.
21. The customer, while entering this website and registering, shall abide by the terms and conditions and shall be deemed to have accepted them.
22. While entering into the service and agreement, it is deemed that the customer has read, understood and agreed to all the terms and conditions of the Firm. No doubts remain unsolved in the mind of the customer.
23. The customer shall not promote any other similar website, mobile app, matrimonial services or matrimonial companies on this website or anywhere in the Firm’s working area.
24. The customer agrees that he/she is registering to find prospective lawful matrimonial alliances for him/her.
25. The Firm is not held liable in case of any wrong or false information provided by other customers. The customer shall enquire before entering into any relation with other customers or profiles.
26. Customers shall pay service/package charges in advance. In case of non-payment or part payment, services up to the paid amount will be activated. All remaining services shall be suspended without notice by the Firm for default in payment.
27. The Firm shall not be held liable in case of failure of server, temporary shutdown during website maintenance, or any other valid reason for temporary inactivation of the website.
28. The customer shall keep their username and password safe and shall not share the same with anyone. In case of theft of username or password, kindly contact the concerned authority immediately. The Firm shall not be held liable for any loss or damages in such cases. The Firm never asks for a customer’s password.
29. The Firm shall contact customers only on the registered mobile number and email address and will never call or mail on other numbers or email IDs.
30. The Firm shall not require any consent of customers in case of featured advertisements, paid or free advertisements on the website.
31. In case of modification in website interface or any change in it, the Firm shall not require any consent of existing or new customers.
32. Indemnity: In case of any misuse or illegal activity which creates any obligation towards another customer, third party or the Firm — such a customer shall indemnify all damages and losses occurred due to him/her.
33. The Firm reserves the right to take all appropriate legal actions in case of breach of any terms and conditions by the customer.
34. Arbitration: In case of dispute regarding any issue related to parties, subject matter or anything between the customer, service point and the Firm — the same shall be resolved as per The Arbitration and Conciliation Act. The award passed by the Arbitrator shall be binding on both parties. In such cases, the sole arbitrator shall be appointed by the Firm and the award shall be treated as final by both parties.
35. The Firm shall have the right to reject and terminate any registration at any time without giving any reason and without notice in case of breach of the conditions mentioned herewith.
36. This agreement is made and accepted by the customer and service point by “entering this website” and by clicking “Accepted” — all terms and conditions are accepted and shall be binding on all parties to this contract. This contract is made with free and full consent, without any obligation and in sound condition, and the same shall be binding on the user/customer and his/her lawful heirs, administrators, intestates, power of attorneys and assignees.
